This field guidance addresses the adjudication of Form I-601A, Application for Provisional Unlawful Presence Waiver in cases involving applicants with criminal history. Memo provides guidance on provisional waivers and “reason to believe.”  Memo instructs officers to review all evidence filed with the I-601A and if it appears that the offense is not a CIMT or qualifies for the petty offense or youtful offender exception to not find a reason to believe that the applicant may be inadmissible under INA 212(a)(2)(A)(i).
